South Korea’s AI Regulatory Framework: An Overview

The AI Basic Act, effective from 22 January 2026, positions South Korea alongside the EU AI Act as one of the world’s most structured and forward-looking AI regulatory regimes. It establishes a horizontal framework that interacts with existing data-protection laws and sector-specific rules, creating a multi-layered compliance environment.

Risk-Based Obligations

Generative AI

Operators must provide transparent disclosure that a service relies on AI and ensure AI-generated content is clearly identifiable, preventing deception by deepfakes or synthetic media.

High-Impact AI

Systems that could significantly affect human life, safety, or fundamental rights (e.g., in healthcare or credit scoring) trigger a comprehensive compliance regime:

  • Implementation of a risk management system to identify, assess, and mitigate harms.
  • Provision of explainability details, including decision logic and training data criteria.
  • Establishment of user protection mechanisms and ongoing human oversight.
  • Documentation of all measures for auditability and traceability.
  • Conducting impact assessments where fundamental rights are at stake.

High-Performance (Advanced) AI

Defined by computational scale (≈10^26 FLOPs) and societal impact, these systems face enhanced safety requirements such as lifecycle risk management, continuous monitoring, incident response, and reporting obligations.

Extraterritorial Application and Local Representation

The AI Basic Act applies to foreign AI operators whose systems affect the Korean market or users. Companies surpassing revenue or user-base thresholds must appoint a local representative to act as a liaison for authorities and manage regulatory requests.

Enforcement and Sanctions

The Ministry of Science and ICT (MSIT) can issue corrective orders, suspend non-compliant services, and levy fines up to 30 million KRW (≈ €20,000). A grace period of roughly one year after the Act’s entry into force allows organizations to build compliance frameworks before strict enforcement begins.

Implementation Mechanisms

Beyond the Act, compliance relies on:

  • Presidential Decrees: Binding operational rules translating high-level provisions into concrete thresholds and procedures.
  • Administrative Guidelines (MSIT, NIA): Detailed, non-binding methodologies that serve as audit references.

Interaction with Data Protection and Sectoral Regulation

AI systems processing personal data must simultaneously satisfy PIPA requirements. Sector-specific regulations may complement AI obligations, especially in risk management and safety domains.

The Act also fosters AI innovation through institutions such as:

  • The National AI Strategy Committee – central coordination at the highest government level.
  • The AI Policy Center – strategy and international cooperation.
  • The AI Safety Research Institute – risk evaluation and standard-setting.

Support mechanisms target startups and SMEs, promoting research, infrastructure, and investment.
