House Hearing: The Need for AI Regulation in Schools

During a recent House Committee on Education and Workforce hearing, bipartisan concerns emerged regarding the implications of artificial intelligence (AI) in K-12 education. Lawmakers expressed worries over risks such as student overreliance on technology and the security of student data.

The Debate on Regulation

The discussion highlighted the ongoing debate over whether and how AI should be regulated at the federal level. Democrats at the hearing advocated for more guardrails, citing executive orders from the Trump administration that have made it challenging to implement regulations at the state level. These orders aim to block state-level regulations while dismantling the U.S. Department of Education.

Conversely, Republicans cautioned against hastily imposing new regulations that could hinder innovation in both education and the workforce. Committee Chair Tim Walberg emphasized the importance of balancing regulation with the need to keep pace with technological advancements.

Impacts of the Trump Administration

The hearing took place a month after President Donald Trump signed an executive order aimed at preempting state laws that regulate AI, with specific exceptions for child safety. Rep. Bobby Scott, the committee’s ranking member, criticized the administration for potentially favoring big tech executives over state protections for citizens against AI-related risks.

Scott pointed out that the ability to study and regulate the impact of AI on education has been stifled under the current administration, citing the closure of the Education Department’s Office of Educational Technology and cuts to federal funding for educational research.

Transparency and Standards in EdTech

Witnesses at the hearing called for greater transparency and standards for educational technology companies deploying AI tools in classrooms. Alexandra Reeve Givens, president and CEO of the Center for Democracy & Technology, noted that many educational technology products lack clarity regarding their AI models, complicating informed decision-making for educators.

Key questions that companies should address include whether their tools are based on learning science, have been tested for bias, and possess adequate security and privacy protections.

Adeel Khan, founder of MagicSchool AI, echoed the need for shared standards and guardrails in AI tools for classrooms, emphasizing that the federal role should focus on protecting children while investing in educator training and resource procurement.

Brookings Institution Report

Additionally, the Brookings Institution released a report analyzing over 400 research articles and interviews with education stakeholders. The report concluded that the risks of AI currently outweigh its benefits in educational settings, posing threats to students’ cognitive, emotional, and social well-being.

To mitigate these risks, Brookings recommends the following framework for K-12 institutions implementing AI:

  • Train teachers and students on when to use AI effectively.
  • Utilize AI in conjunction with evidence-based practices that promote deeper learning.
  • Develop comprehensive AI literacy to ensure understanding of AI capabilities and limitations.
  • Provide robust professional development for educators in using AI responsibly.
  • Establish ethical frameworks for AI use while ensuring equitable access for all students.
