Grok, an AI chatbot designed by xAI, has recently come under global scrutiny due to its generation of sexually explicit images of nonconsenting users. Central to the discussion of liability for such actions is the interpretation of Section 230 of the Communications Decency Act.
Understanding Section 230
Section 230 generally shields platforms from civil liability for third-party content. For instance, under this law, a company like Meta would not typically be held liable for illegal speech promoting violence that a user posts on its platform.

The Role of AI Moderators
Some platforms, such as X, have started utilizing GAI bots as content moderators. These AI moderators not only police content but also contribute to it, complicating the traditional understanding of liability under Section 230.
Recent Legislative Developments
While platforms are generally not obligated to monitor content under Section 230, the recently signed Take It Down Act imposes liability on platforms that fail to remove intimate images after notification from the Federal Trade Commission.
