New AESIA Guidelines to Support Compliance with the AI Act

The Spanish Artificial Intelligence Supervisory Agency (Agencia Española de Supervisión de la Inteligencia Artificial, or AESIA) has released a comprehensive set of 16 guides aimed at assisting organizations in complying with the European Artificial Intelligence Act (AIA). These guides are part of Spain’s pilot initiative, the AI Regulatory Sandbox, which is designed to facilitate the implementation and adherence to the AIA by offering practical, non-binding recommendations aligned with its requirements, pending the approval of harmonized rules across all Member States.

Structure of the Guides

The 16 guides are organized into three distinct groups:

  1. Introductory Guides (Guides 1 and 2)

These documents provide a general and practical overview of the AIA, facilitating an initial understanding through supporting materials and hypothetical use cases that illustrate the application of the rules.

  1. Specialised Technical Guides (Guides 3 to 15)

This section addresses specific legal and technical requirements applicable to high-risk AI systems. Key aspects covered include:

  • Conformity assessment procedures
  • Quality and risk management systems
  • Data governance
  • Transparency
  • Human oversight
  • Accuracy
  • System robustness and cybersecurity
  • Technical documentation
  1. Checklist User Manual (Guide 16)

This guide provides a structured methodology in checklist form, enabling organizations to easily assess their degree of compliance, identify deficiencies, and design a structured conformity plan.

Important Notes on the Guidelines

AESIA has emphasized that these documents do not replace existing regulations and will be subject to review as European standards and guidelines evolve. They are expected to be updated in line with legislative amendments to the Digital Omnibus Package as they are adopted.
