Grok, Deepfakes, and the Collapse of the Content/Capability Distinction

Recent regulatory responses to the large language model (LLM) Grok regarding its use in generating deepfakes reveal something more interesting than mere corporate misconduct. They expose a mismatch between how platform regulation frameworks were designed and how generative AI operates once integrated into platforms by providers themselves. Ex-post content removals and user sanctions are no longer sufficient.

For instance, French prosecutors have initiated a probe following the circulation of AI-generated content, while the U.K.’s Ofcom has treated Grok as a system subject to ex-ante design duties under the Online Safety Act. Regulators in countries such as Australia, Brazil, Canada, Japan, and India have also pressured X by invoking existing sectoral rules. These responses suggest that effective AI regulation may emerge not from comprehensive, AI-specific frameworks, but from applying existing sectoral rules to new capabilities.

The Architecture Problem That Content Policy Can’t Solve

Traditional platform governance operates on a separation of roles: the platform provides capabilities (like hosting and search), while users generate content. Capability regulation imposes restrictions on what the system can do, while content regulation consists of rules about outputs, such as post removal and labeling. This model assumes the platform acts as a content intermediary, whether it behaves content-neutrally or otherwise.

However, Grok’s integration into X has collapsed this distinction. Reports indicate that Grok has been generating nonconsensual sexualized deepfakes of real individuals, including minors. The platform does not merely host or transmit harmful content; its capability to generate that content is intrinsic to its existence. When Grok produces realistic, non-consensual fake images, the standard content moderation approach—detect, remove, sanction—is inadequate. The ability to readily produce unlawful outputs with trivial prompts constitutes a rights violation that requires addressing both the content and the capability itself.

This misunderstanding of harm within socio-technical systems ignores that harms can arise not just from individual actions but from architectures that facilitate such actions. Regulatory frameworks that focus solely on content moderation are limited, as they only address individual instances rather than the systemic conditions that enable harm.

Geoblocking’s Inadequacy for Capability Problems

X’s response to Grok’s outputs—geoblocking certain prompts in specific jurisdictions—illustrates an inadequate solution. When harms are capability-driven, effective mitigation requires controls at the generation level rather than territorial filters applied post hoc. Geoblocking fails to address the core issue, as the harm occurs when harmful content is created, independent of where the triggering user is located.

This concern extends beyond Grok. The traditional tools of jurisdictional enforcement lose efficacy when anyone can generate harmful synthetic content depicting anyone, anywhere. Regulators must shift their focus upstream and govern capabilities at the model level rather than outputs at the content level.

Regulatory Futures

The rapid mobilization of regulators to address Grok’s capabilities reveals what occurs when established harms, such as non-consensual intimate images, confront new production mechanisms like generative AI without adequate safeguards. This response is swift because the harm is not novel; only the method of production has changed. Existing prohibitions can be extended to encompass synthetic content generation without redefining categories.

Grok’s case suggests that effective AI regulation may not stem from comprehensive frameworks but from applying existing harm-based laws to new capabilities. For example, the U.K.’s approach, leveraging the Online Safety Act instead of waiting for bespoke AI legislation, serves as a model.

For developers of general-purpose AI, Grok’s deepfake generation capabilities could be viewed as product defects subject to regulatory scrutiny. Other capabilities may face similar examination, such as those producing malware, impersonating individuals, generating targeted disinformation, or providing instructions for dangerous substances.

In conclusion, the Grok episode indicates a bifurcation in AI governance into two tracks: Track 1 focuses on fast, harm-specific enforcement using existing regulatory frameworks, while Track 2 involves slower, framework-level regulations for systemic risks. The lesson is clear: AI regulation may be emerging differently than anticipated, with existing regulatory frameworks adapting to address new capabilities.
