The housing industry is rapidly adopting artificial intelligence (AI) tools to make crucial decisions regarding home loans and leases. However, as the Trump administration rolls back long-established protections aimed at ensuring fairness in these evaluations, significant concerns arise.

While the use of algorithms to predict outcomes—such as a home’s selling price or a tenant’s ability to afford rent—is not new, recent advancements in user-friendly AI have made these technologies more accessible to mortgage and real estate businesses. This heightened interest has led to a push for the expanded role of computerized systems in the housing sector.

Proponents of AI suggest that it could provide more objective assessments, reduce discriminatory bias, and help to reverse entrenched inequalities. Federal Reserve Governor Michael Barr has highlighted the potential for AI to advance civil rights, but he warns that without careful oversight, it could reinforce discrimination. The narrowing of federal anti-discrimination enforcement under the current administration raises significant concerns for the future of fair housing.

Since taking office, the Trump administration has sought to limit the government’s ability to enforce rules based on “disparate impact”—a method that assesses whether a practice is discriminatory based on its effects on various groups, regardless of intent. This method has been crucial in challenging decisions influenced by algorithmic technology.

In 2024, a federal court approved a settlement exceeding $2 million for rental applicants who claimed they were denied housing due to an algorithm that negatively impacted Black and Hispanic individuals. The plaintiffs argued that the algorithm relied heavily on credit scores, ignoring other factors like housing vouchers that could indicate an applicant’s ability to pay rent.

Under the first Trump administration, the Department of Housing and Urban Development (HUD) acknowledged the importance of disparate impact methods in identifying potential discrimination. However, during President Trump’s second term, HUD’s stance shifted, arguing that such enforcement unfairly penalizes businesses.

Challenges for Consumers

Lisa Rice, president of the National Fair Housing Alliance, emphasizes that relying on individuals to bring complaints is insufficient; government agencies need to be involved to ensure accountability and transparency.

The Industry’s Perspective

Despite concerns, many industry advocates support the rollback of disparate impact rules, arguing that previous regulations were overly expansive. The Community Home Lenders of America contends that stringent oversight could hinder the adoption of beneficial AI tools designed to reduce human bias.

Rob Zimmer, spokesperson for the group, states, “Let’s make sure we have a system that evaluates people based on math—not on personal characteristics.” This sentiment reflects a broader concern that without regulatory changes, businesses may face stifling restrictions or be forced to abandon AI technologies altogether.

As discussions around AI in housing continue, some experts warn that the Biden administration’s focus on preventing discrimination could inadvertently harm the communities it aims to protect. Tobias Peter of the American Enterprise Institute cautions that overcorrection based on assumptions of bias may lead to negative consequences for both lenders and borrowers.

David Dworkin, president of the National Housing Conference, expresses concern over the potential for retroactive consequences as the political landscape shifts. The balance between innovation and regulation remains delicate, and the future of AI in housing hangs in the balance.
