The White House has presented Congress with a six-item framework aimed at establishing a cohesive legislative policy on artificial intelligence (AI). This initiative is intended to provide strong federal leadership that fosters public trust in the development and application of AI technologies in everyday life.

The proposed policy items align with priority areas previously highlighted by the Trump administration. These include:
- Protecting children
- Safeguarding American communities and small businesses
- Promoting intellectual property rights
- Supporting free speech

- Pre-empting state AI laws
Among these, the pre-emption of state laws has been particularly contentious. Efforts by Republicans, such as a proposal from Sen. Ted Cruz to prohibit states from enacting their own AI regulations for ten years, faced significant opposition, culminating in a 99-1 vote against the measure.
The Need for Uniformity
The White House emphasized that the framework can only succeed if it is applied uniformly across the United States. A disjointed array of conflicting state laws could undermine American innovation and the country’s leadership in the global AI arena.
The administration stated, “The Federal government is uniquely positioned to set a consistent national policy that enables us to win the AI race and deliver its benefits to the American people, while effectively addressing the policy challenges that accompany this transformative technology.”
Collaboration with Congress
In the coming months, the administration plans to collaborate with Congress to transform this framework into actionable legislation that the President can endorse. This legislative push follows efforts by Sen. Marsha Blackburn, who introduced a draft AI framework aiming to formalize President Trump’s December 2025 executive order intended to restrict states’ rights concerning AI.
Balancing Regulation and Innovation
The new framework seeks to maintain a balance between light-touch federal regulation that promotes innovation and the need to protect Americans from potential harms associated with AI technologies. These harms may include:
- Censorship
- Burdenous energy costs
- Copyright infringement
- AI-generated child sexual abuse material
This comprehensive approach aims to ensure that while innovation is fostered, the safety and rights of the public are also prioritized.
