New AESIA Guidelines to Support Compliance with the AI Act

The Spanish Artificial Intelligence Supervisory Agency (Agencia Española de Supervisión de la Inteligencia Artificial, or AESIA) has recently released a set of 16 guides aimed at assisting organizations in complying with the European Artificial Intelligence Act (AIA). These guides are part of Spain’s pilot initiative, the AI Regulatory Sandbox, designed to facilitate the implementation of the AIA by offering practical, non-binding recommendations that align with the AIA’s requirements.

Structure of the Guides

The 16 guides are categorized into three distinct groups:

1. Introductory Guides

Guides 1 and 2 provide a general overview of the AIA, offering supporting materials and hypothetical use cases to illustrate the application of the rules.

2. Specialised Technical Guides

Guides 3 to 15 address specific legal and technical requirements relevant to high-risk AI systems. Key aspects covered include:

  • Conformity assessment procedures
  • Quality and risk management systems
  • Data governance
  • Transparency
  • Human oversight
  • Accuracy
  • System robustness
  • Cybersecurity
  • Technical documentation

3. Checklist User Manual

Guide 16 provides a structured methodology in checklist form, enabling organizations to assess their compliance levels, identify deficiencies, and design a structured conformity plan.

AESIA emphasizes that these guides do not replace existing regulations and are subject to revision as further European standards and guidelines are developed. Updates will align with legislative amendments related to the Digital Omnibus Package.

In the coming weeks, additional publications will announce the specific content of these guides, providing organizations with the necessary tools to navigate the complexities of AI compliance.
