During the panel, moderated by AI and automation consultant Johan Steyn, experts emphasized that while the AI policy is designed to balance innovation with ethical responsibility, the absence of clear consequences for non-compliance could lead to detrimental outcomes for firms that do not prioritize adherence to ethical standards.

Dr. Rejoice Malisa-van der Walt, CEO and co-founder of AI Nexus Research, Training & Consultancy, highlighted that although South Africa’s AI policy framework follows the model of the European Union’s AI Act, it lacks the enforcement mechanisms that provide necessary accountability for violators.

Experts are worried that the leniency of the South African Information Regulator towards transgressors of current laws, such as the Protection of Personal Information Act (POPIA), reflects a broader issue of lack of enforcement that could extend to AI regulations. Steyn pointed out that despite POPIA being a comprehensive legislation, the lack of accountability has resulted in numerous breaches without any significant repercussions.

Steyn stated, “There are probably 10,000 breaches we don’t know about, and already they want to add AI on top of that. How do we enforce it?” This sentiment underscores the urgent need for a robust framework that not only sets guidelines but also imposes strict penalties for non-compliance.

The EU AI Act, which came into force on August 1, 2024, is noted for its stringent penalties, including fines of up to €35 million or 7% of a company’s global annual turnover for serious violations.
