AI does not possess inherent fairness or ethical qualities. Rather, it tends to mirror and amplify existing societal biases. AI-driven decisions in critical sectors like healthcare, education, and financial services pose direct risks to socio-economic rights. For instance, an algorithm commonly used in the U.S. healthcare system prioritized patients based on their spending rather than their actual medical needs.

Responsible AI is not solely concerned with the accuracy of machines; it emphasizes whether the systems are equitable, accountable, and just. AI systems are not neutral; they embody the values and assumptions of their creators, operating within sociotechnical ecosystems influenced by law, policy, and institutional design.

Systems trained through reinforcement learning from human feedback (RLHF) evolve based on user interaction, yet companies rarely disclose the extent of user influence. This opacity diminishes public understanding and agency.

Furthermore, many AI systems undergo training in controlled environments, which can lead to a mismatch between design assumptions and real-world applications, particularly in sectors like agriculture and healthcare.

III. How: Regulating and Rethinking AI

1. Human Rights as a Framework

Human rights offer a strong foundation for evaluating the societal impact of AI. However, regulation must keep pace with technological advancements. While ethics may evolve more rapidly than legislation, without enforceable legal standards, ethical AI can become merely performative. As emphasized by organizations like UNESCO, ethical progress must be accompanied by regulatory readiness.

A structured Human Rights Impact Assessment (HRIA) framework can be applied across the AI lifecycle to assess risks:

In contrast, rights-based approaches center on dignity, equity, and participation, particularly for marginalized communities. A hybrid model that combines these approaches is essential, tailoring principles to national readiness and cultural interpretations of fairness.

IV. The Limits of Technical Fixes

While exposing vulnerabilities in large language models (LLMs) through red teaming is important, it is insufficient for addressing deeper structural inequalities or the concentration of power in AI development.

Engineers often understand how to create AI systems but lack insight into why ethical considerations are necessary. Achieving ethical AI requires interdisciplinary collaboration involving philosophy, law, sociology, and input from affected communities.

The mainstream AI landscape is predominantly shaped by institutions in the Global North, emphasizing efficiency and optimization. Alternative frameworks from regions like Africa and perspectives such as Ubuntu, communitarianism, and feminist theory offer more inclusive and relational approaches.

V. Building Towards Accountability

Establishing transparent value chains is crucial. Every participant, from data annotators to cloud service providers, must be visible and accountable. Issues of reinforcement, decision-making, and responsibility should not be obscured by technical jargon.

Furthermore, effective redress mechanisms must be implemented, including:

  • Compensation for harm
  • Deletion of problematic training data
  • Public apologies or retraining of systems

Trust in AI systems is contingent upon trust in the institutions that develop them. If individuals do not believe that governments or corporations respect their rights, they will be reluctant to trust the systems built upon these technologies. Regulation must precede deployment.

VI. The Missing Infrastructure for Algorithmic Accountability in the Global South

As AI systems developed using data from the Global North are increasingly applied in the Global South, the absence of regionally grounded oversight frameworks poses a significant threat. Without mechanisms to determine the appropriateness, safety, and fairness of these systems for local contexts, we risk perpetuating digital colonialism under the pretense of innovation.

This issue is not merely technical; it is fundamentally institutional. Future oversight efforts must consider:

  • Data relevance: Does the data accurately reflect the social and environmental context?
  • Infrastructure capacity: Are the systems compatible with local hardware, bandwidth, and energy resources?
  • Cultural specificity: Are regional norms, languages, and social dynamics taken into account?
  • Human rights impact: Who is affected, and what safeguards are in place?

The Global South requires not only inclusion in AI development but also governance power, evaluative autonomy, and decision-making authority.

Responsible AI transcends mere compliance; it represents a paradigm shift. We must critically examine whether AI will reinforce existing inequalities or serve as a vehicle for justice and shared prosperity.

Responsibility for ethical AI does not rest solely on developers; it must also be shouldered by regulators, funders, deployers, and users. If we fail to define the principles AI should uphold, it will inevitably reflect the status quo.

To ensure a just and equitable AI future, we must not delegate our ethical responsibilities to algorithms.
