AI Governance & Why It Is Necessary

In recent years, the conversation around AI governance has intensified, particularly following a significant open letter signed by technology leaders urging for the establishment of stronger regulations for AI systems. The risks associated with AI technology highlight the necessity for a comprehensive governance framework to ensure ethical practices and compliance with laws.

What Is AI Governance?

AI governance encompasses a set of processes, principles, and policies that guide the ethical development and deployment of AI systems. It aims to ensure transparency, accountability, and adherence to ethical standards, while also minimizing risks associated with biases and privacy violations.

The training of AI models requires significant volumes of data. The effectiveness of AI in providing answers and making decisions is contingent on the data it is trained on. The three Vs of AI training—volume, variety, and velocity—are critical for developing a well-rounded AI model:

  • Volume: More information contributes to comprehensive knowledge.
  • Variety: Different data types foster nuanced understanding.
  • Velocity: Rapid processing of information enhances real-time decision-making.

However, the reliance on large datasets raises concerns about data privacy and the potential for ethical violations.

Data Privacy Risks in AI Training

Training Data Issues

AI models often utilize existing databases or internet-sourced information for training. This raises significant privacy risks, particularly if any of the data is personal or identifiable. Issues arise when:

  1. The subject did not provide informed consent for their data to be used.
  2. Consent was given for one purpose but not for another.
  3. Personal data is disclosed in AI responses.

Bias and Discrimination Risks

The principle of Garbage In, Garbage Out (GIGO) is a critical factor in AI. The accuracy of AI outputs is directly linked to the quality of the training data. Biases can manifest in various ways:

  • Training data biases: Skewed datasets can lead to underrepresentation of certain groups.
  • Algorithmic biases: Errors in programming can reflect the prejudices of developers.

According to privacy by design principles, only the minimum necessary data should be collected for specific purposes. However, the demand for large volumes of data in AI training contradicts this principle, necessitating the implementation of robust AI governance.

AI Governance Frameworks and Laws

The United States has made early attempts to define an AI governance framework, with executive orders focusing on safe AI development. However, as of now, there is no comprehensive federal AI law. In contrast, the EU AI Act categorizes AI systems based on their risk levels, establishing guidelines that extend beyond EU borders.

The four risk categories established by the EU AI Act include:

  • Minimal or no risk: Low-stakes applications like spam filters.
  • Limited risk: Systems that interact with users, requiring minimal transparency.
  • High-risk: Applications impacting well-being and safety, necessitating stringent governance.
  • Unacceptable risk: Systems that violate fundamental rights, which are prohibited.

Other AI Frameworks: NIST, ISO, and the OECD

Frameworks such as the NIST AI Risk Management Framework and the ISO 42001 standard provide guidelines for responsible AI management. The OECD’s updated principles for trustworthy AI emphasize the importance of transparency and accountability in AI development.

Levels of AI Governance

AI governance operates on multiple levels:

  • Global Governance: International guidelines for managing cross-border AI risks.
  • National Governance: Regulations aligning AI development with local laws and priorities.
  • Industry-Specific Governance: Tailored standards for high-risk sectors like healthcare and finance.
  • Technical Governance: Protocols ensuring ethical AI system design.
  • Organizational Governance: Internal policies for ethical AI practices within companies.

Organizations must educate users on AI risks and empower them to control their data to foster informed consent and trust in AI technologies.
