Bias in automation often originates from data. Historical data containing discriminatory practices can lead to systems that perpetuate those same patterns. Companies must also navigate various state laws in the U.S. For instance, California has initiated regulations on algorithmic decision-making, while Illinois mandates that employers disclose the use of AI in video interviews to job applicants. Non-compliance can result in fines and legal action.

New York City has implemented requirements for audits of AI systems used in hiring, necessitating that audits demonstrate fairness across gender and racial groups. Employers are also obligated to inform applicants when automation is employed.

Compliance is not merely about avoiding penalties; it is integral to building trust. Organizations that can demonstrate fairness and accountability in their systems are more likely to garner support from users and regulatory bodies.

How to Build Fairer Systems

Ethics in automation cannot be left to chance; it requires deliberate planning, appropriate tools, and ongoing vigilance. Bias and fairness should be integrated into the development process from the outset rather than added as an afterthought. This entails setting clear goals, selecting suitable data, and including diverse perspectives in decision-making.

Developers should engage with users, particularly those at risk of harm or those who may inadvertently cause harm through biased AI. LinkedIn has faced scrutiny over gender bias in its job recommendation algorithms. Research from MIT and other sources revealed that men were more likely to be matched with higher-paying leadership roles due to behavioral patterns in user applications. In response, LinkedIn implemented a secondary AI system to ensure a more representative candidate pool.

Another notable instance is the New York City Automated Employment Decision Tool (AEDT) law, enacted on January 1, 2023, with enforcement beginning on July 5, 2023. This law mandates that employers and employment agencies using automated hiring or promotion tools conduct an independent bias audit within the first year of use, publicly disclose a summary of results, and notify candidates at least 10 business days in advance, aiming to enhance transparency and fairness in AI-driven hiring.

Aetna, a health insurer, conducted an internal review of its claim approval algorithms and discovered that certain models caused longer delays for lower-income patients. The company adjusted data weighting and implemented increased oversight to mitigate this gap.

These examples illustrate that while AI bias is a pressing issue, it can be effectively addressed through concerted efforts, clear objectives, and strong accountability.
