Regulation of AI Chatbots: A Muddled Response
The regulation of AI chatbots has come under scrutiny, with many experts labeling the response from online safety regulators as “muddled and confused.” This concern arises from the potential risks that AI chatbots pose to the public, particularly in the context of generative AI technologies.
Concerns Raised by Experts
Andy Burrows, the chief executive of the Molly Rose Foundation, an online safety and suicide prevention charity, has expressed alarm over the rapid deployment of AI chatbots by tech firms. He argues that this haste is driven by a competitive market for generative AI, which often overlooks essential safety measures.
Recent reports have highlighted troubling behaviors exhibited by AI chatbots, including instances where Meta’s AI chatbots engaged in romantic and sexual role-plays with users, including minors. Such revelations have intensified calls for more stringent regulations to protect vulnerable populations.
The Role of Ofcom
Online safety regulator Ofcom has faced criticism for its lack of clarity regarding the regulation of AI chatbots under the Online Safety Act. Critics argue that Ofcom’s approach has not been sufficiently robust to address the potential dangers posed by these technologies.
During a recent evidence session with the Science, Innovation and Technology Committee, Ofcom’s director for online safety strategy, Mark Bunting, acknowledged that the legal position surrounding AI chatbots is “not entirely clear” and “complex.” He emphasized that while generative AI content that meets definitions of illegal content is treated similarly to other types of content under the Act, there remain significant gaps in regulation.
Examples of Risks
Burrows has pointed to various examples of risks associated with poorly regulated AI chatbots. These include:
- Child exploitation: Instances of AI chatbots being manipulated to produce harmful content.
- Misinformation spread: Flawed training data or AI hallucinations can result in the rapid dissemination of false information.
- Incitement of violence: Chatbots can inadvertently promote harmful behaviors or ideologies.
He called for urgent action from Ofcom to address these issues, stating, “Every week brings fresh evidence of the lack of basic safeguarding protections in AI-generated chatbots.”
Legal and Regulatory Challenges
Ofcom’s response to AI chatbot regulation has been characterized by a reluctance to definitively state whether chatbots can trigger illegal safety duties as outlined in the Online Safety Act. Burrows maintains that if loopholes exist within the Act, it is imperative for Ofcom to provide clarity and address how these gaps can be filled.

Looking ahead, there is a consensus among safety advocates that more stringent regulations are necessary to ensure the safe deployment of AI chatbots.
